Prickett Jones Reaches Proposed Settlement in Cencora Opioid Litigation

The parties in Lebanon County Employees’ Retirement Fund v. Steven H. Collis et al., C.A. No. 2021-1118-JTL (Cencora, Inc. (f/k/a AmerisourceBergen Corporation) Derivative Litigation) jointly submitted a proposed stipulation of settlement to the Court on August 15, 2025, with Prickett, Jones & Elliott, P.A. serving as counsel for Plaintiffs. The complaint in the action sought billions of dollars in damages, alleging the Company’s officers and directors breached their fiduciary duties by failing to adopt, implement, or oversee reasonable policies and practices to prevent the unlawful distribution of opioids and failed to act when presented with evidence of widespread illegal opioid sales. The years-long litigation began with an 8 Del. C. § 220 books and records demand and included two appeals to the Delaware Supreme Court and the creation by the Company of a Special Litigation Committee.

A settlement hearing will be held to address the terms of the proposed settlement on November 13, 2025 at 3:15 p.m. at the Leonard L. Williams Justice Center, 500 North King Street, Wilmington, Delaware 19801.
